Regulating the change in the EU electricity markets
The energy transition leads to a paradigm shift in the energy sector and electricity markets. The doctoral thesis studies the interaction between the energy transition and electricity market law. The study focuses on what the role of legislation in this transition is and how the energy transition should be addressed in the legislation. This question is analysed in the context of the EU electricity market law.
The research question is studied from three different angles in three published and peer-reviewed articles. New technological and innovative solutions are of particular interest in the thesis. The summary of the thesis builds on the findings of the articles and discusses the core themes, challenges and possible solutions in the interaction between electricity market legislation and the energy transition. The thesis concludes that the energy transition will evidently generate new challenges to the legislators.
The study contributes to the evolving legal research in this field, focusing on the risk of regulatory disconnection and regulatory failure in the EU electricity markets. The transitional phase of the energy sector and the characteristics of the electricity market law in the EU highlight the importance of considering these risks. The thesis provides examples on the challenges and discusses the solutions to cope with the regulatory disconnection. There is no one solution to ‘regulating the change’, thus different approaches need to be applied to find the balance between tomorrow and yesterday.
